Terms of Service

PLEASE CAREFULLY REVIEW THIS TERMS OF SERVICE AGREEMENT (THE “TERMS”). SAFEME INC. (“SAFEME,” “WE,” “US,” OR “OUR”) PROVIDES ACCESS TO AND USE OF THE SUNIQ MOBILE APPLICATION, WEBSITE, AND RELATED SERVICES (COLLECTIVELY, THE “SERVICE”). BY DOWNLOADING, INSTALLING, OR USING THE SERVICE, YOU AGREE THAT (1) YOU HAVE READ, UNDERSTAND, AND ACCEPT THESE TERMS, (2) YOU ARE AT LEAST 18 YEARS OLD, AND (3) YOU HAVE THE AUTHORITY TO ENTER INTO THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

IMPORTANT NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION (SECTION 14) THAT AFFECTS YOUR LEGAL RIGHTS. BY USING THE SERVICE, YOU AGREE TO RESOLVE DISPUTES THROUGH INDIVIDUAL ARBITRATION AND WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR OTHER COLLECTIVE PROCEEDINGS. YOU HAVE THE RIGHT TO OPT OUT OF ARBITRATION AS DESCRIBED IN SECTION 14.6.

TRIAL SUBSCRIPTIONS: IF YOU START A FREE TRIAL, YOUR SUBSCRIPTION WILL AUTOMATICALLY CONVERT TO A PAID SUBSCRIPTION AT THE END OF THE TRIAL PERIOD UNLESS YOU CANCEL AT LEAST 24 HOURS BEFORE THE TRIAL ENDS. SEE SECTION 6.4 FOR DETAILS.

1. DEFINITIONS

“Service” means the SunIQ application, website, and all associated features, including but not limited to UV index monitoring, safe sun exposure timing, vitamin D tracking from sun exposure and supplements, tanning progress and tan-logging with photos or videos, sun session history, data export functionality, optional account creation and Cloud Backup, personalized recommendations, weather integration, educational content, notifications, and any other tools or features we may offer.

“User” means any individual who accesses or uses the Service.

“Account” means a SunIQ account created by a User to access optional account-based features, including Cloud Backup.

“Cloud Backup” means the optional feature described in Section 5 that allows certain categories of User data to be backed up to SafeMe’s cloud infrastructure for restoration to a device.

“User Content” means any data, entries, photos, videos, notes, or other content that you generate, submit, upload, or provide through the Service, including content backed up to Cloud Backup.

“Premium Features” means features made available only through a paid subscription.

2. LICENSE GRANT

Subject to your compliance with these Terms, SafeMe grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, solely for your personal, non-commercial use.

3. PROHIBITED CONDUCT

You shall not, and shall not permit any third party to:

(a) Copy, modify, adapt, translate, decompile, reverse engineer, or create derivative works of the Service.

(b) Use the Service for any unlawful purpose or in violation of applicable law.

(c) Attempt to disrupt, interfere with, or gain unauthorized access to SafeMe’s systems, to other Users’ accounts or data, or to the cloud infrastructure supporting the Service.

(d) Remove or obscure any copyright, trademark, or other proprietary notices.

(e) Distribute, license, sell, lease, rent, or sublicense the Service.

(f) Harvest or mine data, including Personal Information, through automated means.

(g) Use the Service if you are under eighteen (18) years of age.

(h) Create an Account using false information, impersonate another person, share your Account credentials, allow another person to use your Account, or create multiple Accounts to evade suspension or termination.

(i) Upload any User Content that infringes any third party’s rights, contains images or videos of any person other than yourself without that person’s consent, contains images or videos of any minor, or that is unlawful, obscene, defamatory, threatening, harassing, or otherwise objectionable.

(j) Engage in any other conduct that SafeMe, in its sole discretion, considers inappropriate, harmful to the Service or its users, or inconsistent with the intended purpose of the Service.

4. MEDICAL DISCLAIMER AND SUN SAFETY LIABILITY

4.1 UV Index Monitoring and Sun Exposure Recommendations The SunIQ app provides real-time UV index monitoring, safe sun exposure timers, and personalized recommendations for vitamin D optimization based on:

  • Current UV index data from WeatherKit and other weather sources
  • Local weather conditions including cloud cover
  • Your selected Fitzpatrick skin type
  • Your age and body weight
  • Time of day and seasonal variations
  • Geographic location and altitude

These inputs help calculate:

  • Safe exposure duration before burning risk
  • Estimated vitamin D production based on exposed skin area
  • Age-adjusted vitamin D synthesis rates (which decline with age)
  • Weight-based vitamin D requirements and storage capacity

These features and recommendations are:

  • Generated using scientific research on UV exposure and vitamin D synthesis
  • Intended as educational tools and general guidelines only
  • Not medical advice or prescriptions for sun exposure
  • Not guarantees against sunburn, skin damage, or vitamin D deficiency
  • Not substitutes for professional medical consultation or UV monitoring devices

4.2 Vitamin D Tracking and Calculation Features SunIQ’s vitamin D tracking capabilities include:

  • Estimation of vitamin D generated from sun exposure sessions
  • Tracking of vitamin D from food sources using standard IU values
  • Monitoring of supplement intake with customizable daily amounts
  • Daily, weekly, and monthly vitamin D analytics
  • Progress tracking toward daily vitamin D goals
  • Default daily vitamin D target settings (customizable by user)
  • Estimation of current vitamin D blood levels (ng/ml or nmol/L)
  • Ability to input actual lab test results for tracking
  • Projections of vitamin D levels based on intake and lab history

IMPORTANT LIMITATIONS:

Vitamin D Calculations:

  • All vitamin D calculations are estimates based on generalized formulas
  • Individual vitamin D synthesis rates vary dramatically between people
  • The app cannot account for factors such as body fat percentage, genetic variations, or existing vitamin D levels
  • These features should never replace blood tests or medical vitamin D assessments
  • Vitamin D recommendations are not personalized medical advice

Blood Level Estimations:

  • Vitamin D blood level estimates (ng/ml) are approximations based on:
    • Your reported intake from sun, food, and supplements
    • General population averages and scientific models
    • Any lab results you choose to enter
  • These estimates CANNOT replace actual blood tests
  • Individual vitamin D metabolism varies greatly and affects actual blood levels
  • Factors affecting accuracy include:
    • Absorption efficiency
    • Body weight and composition
    • Genetic factors
    • Health conditions
    • Medication interactions
  • Lab test entries are for tracking purposes only – we do not verify or validate these entries
  • Even with lab test data, our projections between tests are estimates only

Food IU Values:

  • Food vitamin D content (IU values) are based on standard nutritional databases and scientific literature
  • Actual vitamin D content in foods can vary significantly based on:
    • Source and quality of the food
    • Preparation methods
    • Storage conditions
    • Seasonal variations
    • Geographic origin
  • Food database values are estimates and may not reflect the actual vitamin D content of specific items you consume
  • We cannot guarantee the accuracy of third-party nutritional data

Default Settings and Recommendations:

  • Default daily vitamin D targets are based on general guidelines, not personalized medical advice
  • Your actual vitamin D needs may differ significantly based on:
    • Current vitamin D blood levels
    • Medical conditions
    • Medications
    • Lifestyle factors
    • Geographic location
  • Default supplement settings are for tracking purposes only and do not constitute dosage recommendations
  • Blood level targets are general ranges, not personalized medical recommendations

Lab-Based Recommendations:

  • If you enter lab results, the app may suggest daily IU intake to reach your goal levels
  • These suggestions are based on general population models and mathematical estimates
  • Suggested daily IU intake CANNOT account for:
    • Your individual absorption rate
    • Metabolic differences
    • Health conditions affecting vitamin D metabolism
    • Drug interactions
    • Dietary factors
  • Our recommendations are educational estimates only, NOT medical prescriptions
  • The same blood level goal may require vastly different IU intake for different individuals
  • Never adjust your vitamin D supplementation based solely on app recommendations
  • Always have follow-up lab tests to verify actual changes in blood levels
  • Consult healthcare providers before making any changes to supplementation

UV Exposure Recommendations:

  • Daily UV exposure suggestions are generalized estimates
  • Safe UV exposure varies dramatically between individuals
  • Our recommendations cannot replace professional medical guidance
  • Never exceed your personal comfort level regardless of app suggestions
  • Always consult healthcare providers before starting or changing vitamin D supplementation

The blood level estimation feature is for educational tracking only. Do NOT use estimated levels to make medical decisions. Only actual blood tests performed by qualified laboratories can determine your true vitamin D status. Always consult healthcare providers for vitamin D testing and supplementation guidance.

You acknowledge that all vitamin D tracking features are educational tools only and should not replace professional nutritional or medical guidance.

4.3 Tanning and Sun Exposure Logging The app’s tanning features and sun session logging:

  • Allow tracking of tanning progress and sun exposure history
  • Provide analytics on cumulative UV exposure
  • Include photo and video documentation capabilities for tan progression
  • Are intended for personal record-keeping only

YOU EXPRESSLY ACKNOWLEDGE:

  • Any tan is evidence of skin damage at the cellular level
  • There is no “safe” or “healthy” tan from UV exposure
  • Repeated tanning increases health risks
  • The app’s features should not encourage excessive sun exposure
  • Cosmetic tanning goals should never compromise skin safety

4.4 User Acknowledgment and Sole Responsibility By using SunIQ’s UV monitoring, sun timer, vitamin D tracking, and related features, you acknowledge and agree that:

UV Exposure Varies Based On:

  • Individual genetic factors and natural skin pigmentation
  • Current medications (especially photosensitizing drugs)
  • Recent sun exposure and existing tan level
  • Proper use and reapplication of sunscreen
  • Reflective surfaces (water, sand, snow, concrete)
  • Altitude and atmospheric conditions
  • Age and skin condition

You Are Solely Responsible For:

  • Continuously monitoring your skin’s response to sun exposure
  • Immediately seeking shade if you notice any redness or discomfort
  • Using appropriate sun protection (broad-spectrum sunscreen SPF 30+, protective clothing, hats, sunglasses)
  • Adjusting exposure times based on your individual sensitivity
  • Consulting healthcare providers about your vitamin D needs
  • Understanding your personal risk factors
  • Making informed decisions about sun exposure

4.5 Express Limitation of Liability NO LIABILITY FOR UV-RELATED INJURIES OR CONDITIONS: SafeMe Inc., its parent company, subsidiaries, affiliates, officers, directors, employees, agents, partners, and licensors SHALL NOT BE LIABLE for any:

  • Sunburn or sun poisoning
  • Skin damage, photoaging, or hyperpigmentation
  • Development of any skin conditions or diseases
  • Eye damage from UV exposure
  • Vitamin D deficiency or toxicity
  • Allergic reactions or photosensitivity
  • Heat-related illness during sun exposure
  • Any other health conditions related to UV exposure or vitamin D

This limitation applies regardless of:

  • Whether you followed the app’s recommendations
  • The accuracy of UV index data
  • Any malfunction of the app or its features
  • Your reliance on the app’s calculations or timers

ASSUMPTION OF ALL RISKS: You expressly assume ALL risks associated with sun exposure and vitamin D management, acknowledging that:

  • UV radiation causes cumulative and often irreversible skin damage
  • No app or algorithm can predict individual UV tolerance
  • Environmental UV levels can change rapidly
  • Vitamin D needs vary significantly between individuals
  • The app is a tool, not a medical device or professional guide

4.6 Medical Disclaimer SunIQ DOES NOT PROVIDE MEDICAL ADVICE. This app is not FDA-approved and is not intended as a medical device. The Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The app should not replace:

  • Regular skin examinations by dermatologists
  • Blood tests for vitamin D levels
  • Professional medical consultations
  • Prescribed vitamin D supplementation
  • Medical UV phototherapy treatments

Always consult qualified healthcare providers for:

  • Personalized vitamin D recommendations
  • Skin health screening
  • Treatment of sun damage
  • Photosensitivity concerns
  • Any health questions related to sun exposure

4.7 Critical Safety Warnings

  • Children and Infants: Children under 6 months should avoid direct sun exposure. Older children require extra protection and shorter exposure times
  • High-Risk Groups: Individuals with fair skin (Types I-II), family history of skin conditions, numerous moles, or immunosuppression must exercise extreme caution
  • Medications: Many medications increase photosensitivity. Consult your pharmacist or doctor
  • Peak UV Hours: UV radiation is typically strongest during midday hours
  • Environmental Factors: UV intensity varies with elevation and reflective surfaces
  • Sunscreen: Always use broad-spectrum, water-resistant sunscreen with minimum SPF 30, reapplied regularly
  • Eye Protection: UV exposure can cause eye damage. Wear UV-blocking sunglasses

4.8 Data Accuracy and Technical Limitations

  • UV index data is obtained from WeatherKit and third-party weather services
  • Actual UV levels at your precise location may differ from reported values
  • Cloud cover can reduce but not eliminate UV radiation
  • The app requires active internet connection for current UV data
  • GPS accuracy affects location-based UV calculations
  • Technical glitches, service outages, or data delays may occur
  • SafeMe is not responsible for third-party data accuracy or availability

App Malfunction and Data Display Errors:

  • CRITICAL WARNING: Technical errors, bugs, or malfunctions may cause the app to display incorrect UV index values, vitamin D calculations, or sun exposure recommendations
  • You acknowledge that software errors can and do occur in all applications
  • NEVER rely solely on the app’s displayed values for safety decisions
  • Always use multiple sources of UV information and your own judgment
  • Visually assess actual sun conditions before and during exposure
  • If displayed values seem inconsistent with actual conditions, assume the app is incorrect
  • We strongly recommend using physical UV monitoring devices for critical decisions
  • The app is a supplementary educational tool only, not a safety device

You expressly acknowledge and assume the risk that:

  • The app may display UV 0 when actual UV levels are dangerous
  • Timer functions may malfunction and not alert you properly
  • Calculations may be incorrect due to software errors
  • Data synchronization issues may show outdated information
  • Your device’s sensors or GPS may provide inaccurate data to the app

4.9 Prohibited Uses You agree NOT to use SunIQ:

  • As a medical device or diagnostic tool
  • To treat or manage any medical condition
  • In place of professional medical care
  • To determine safe exposure times for phototherapy
  • For commercial tanning services
  • To encourage minors to tan or have excessive sun exposure

4.10 Application of Medical Disclaimers These medical disclaimers and limitations of liability apply to:

  • All features and calculations within the SunIQ mobile application
  • Any educational content, blog posts, or articles on our website
  • Social media posts and marketing materials
  • Email communications about sun exposure, vitamin D, or tanning
  • Any health or wellness information we provide through any channel

5. ACCOUNTS AND CLOUD BACKUP

5.1 Accounts Are Optional. Creating a SunIQ Account is optional. You may use the Service without creating an Account, in which case your data remains on your device as described in our Privacy Policy. Certain features of the Service, including Cloud Backup, require you to create an Account.

5.2 Eligibility. To create an Account, you must be at least eighteen (18) years of age and capable of entering into a binding agreement. By creating an Account, you represent and warrant that you meet these requirements and that the information you provide is accurate and current.

5.3 Account Security. You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account. You agree to:

  • Use a strong, unique password or, where available, a third-party sign-in method such as Sign in with Apple or Sign in with Google
  • Not share your credentials with any other person
  • Not allow any other person to use your Account
  • Notify SafeMe promptly at [email protected] if you suspect any unauthorized access to or use of your Account

SafeMe is not liable for any loss or damage arising from your failure to safeguard your credentials or from unauthorized use of your Account.

5.4 One Account Per Person. You may maintain only one SunIQ Account at a time. You may not create an Account using false information, impersonate another person, create an Account on behalf of anyone other than yourself, or create a new Account to evade suspension or termination of a prior Account. Accounts are personal and non-transferable.

5.5 Account Termination by You. You may delete your Account at any time from within the SunIQ app or by contacting us at [email protected]. Upon verified deletion, your authentication record and all associated Cloud Backup data will be removed from our systems within the timeframe described in our Privacy Policy.

5.6 Account Termination by SafeMe. SafeMe may suspend or terminate your Account at any time, with or without notice, if:

  • You violate these Terms or any applicable law
  • Your Account has been inactive for twenty-four (24) consecutive months, as described in our Privacy Policy
  • Your use of the Service creates risk or possible legal exposure for SafeMe or other users
  • SafeMe is required to do so by law
  • SafeMe discontinues the Service or any portion of it, as described in Section 7.4

Upon termination, your license ends, your access to Cloud Backup ceases, and your Cloud Backup data will be handled as described in our Privacy Policy. SafeMe has no obligation to provide you with any data retained by SafeMe prior to termination, though it will make reasonable efforts to do so where required by applicable law.

5.7 Cloud Backup. Cloud Backup is an optional feature of the Service that allows certain categories of your data, as described in our Privacy Policy, to be backed up to SafeMe’s cloud infrastructure so that it may be restored if you lose access to your device or sign in to SunIQ on another device.

5.8 Scope and Limitations of Cloud Backup. You acknowledge and agree that:

  • Cloud Backup is provided on a best-efforts basis and is not guaranteed to be uninterrupted, error-free, complete, or timely
  • SafeMe does not guarantee that all of your data will be successfully backed up, that any backup will be successfully restored, or that any particular item of data will be preserved
  • Cloud Backup is not a substitute for your own backup practices. You are encouraged to maintain independent copies of any data you consider important, including by using the in-app export feature described in Section 10.4
  • SafeMe may impose reasonable storage limits, file size limits, retention periods, or other technical limits on Cloud Backup, and may change these limits from time to time
  • SafeMe may modify, suspend, or discontinue Cloud Backup, in whole or in part, at any time, consistent with Section 7.4

5.9 Subscription Tier and Cloud Backup. Cloud Backup is offered as part of the Service. Availability, storage limits, retention periods, and other features of Cloud Backup may vary based on your subscription plan. If your paid subscription lapses, expires, or is cancelled:

  • Your existing Cloud Backup data will be retained and will remain accessible to you in a read-only capacity, meaning you will continue to be able to restore your backup to a device
  • New data will not be backed up to Cloud Backup until you reactivate a qualifying subscription
  • You may continue to delete your Cloud Backup data or your Account at any time
  • SafeMe reserves the right to modify this lapse behavior in the future, provided that SafeMe will not delete your Cloud Backup data solely as a result of subscription lapse without providing you with advance notice and a reasonable opportunity to export or restore your data

5.10 Your Content. As between you and SafeMe, you retain all right, title, and interest in and to your User Content. SafeMe claims no ownership of your User Content.

5.11 License to Your Content. Solely to provide the Service to you, you grant SafeMe a limited, worldwide, non-exclusive, royalty-free license to host, store, back up, transmit, process, display to you, and restore to you the User Content you upload to Cloud Backup. This license exists only for the purpose of providing Cloud Backup and related features to you, terminates when your User Content is deleted from our systems, and does not grant SafeMe any right to:

  • Use your User Content for advertising, marketing, or promotional purposes
  • Sell, license, or otherwise transfer your User Content to any third party, except to our processors as necessary to operate the Service
  • Use your User Content to train machine learning or artificial intelligence models
  • Display your User Content to any other user or to the public

SunIQ does not include any feature for sharing User Content with other users or the public. Your User Content is visible only to you.

5.12 Content Responsibility and Restrictions. You are solely responsible for your User Content and for ensuring that you have all rights necessary to upload it to the Service. You agree not to upload any User Content that:

  • Infringes or violates any third party’s intellectual property, privacy, publicity, or other rights
  • Contains images or videos of any person other than yourself without that person’s consent
  • Contains images or videos of any minor
  • Is unlawful, obscene, defamatory, threatening, harassing, or otherwise objectionable
  • Contains malware, viruses, or any other code intended to harm the Service or its users

SafeMe reserves the right, but is not obligated, to remove any User Content from Cloud Backup that SafeMe, in its sole discretion, believes violates these Terms or applicable law, or to suspend or terminate Accounts associated with such content.

5.13 Reporting. If you believe User Content stored within the Service violates your rights or applicable law, you may report it to SafeMe at [email protected]. For claims of copyright infringement, please include the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512).

6. SUBSCRIPTIONS AND PAYMENTS

6.1 Plans and Fees. The Service offers free basic functionality and subscription-based Premium Features. Subscription fees, durations, and features are described in-app and are subject to change with notice.

6.2 Automatic Renewal. Subscriptions automatically renew at the end of each term unless cancelled at least twenty-four (24) hours before the renewal date via your App Store or device subscription settings.

6.3 Cancellations & Refunds. All fees are non-refundable. Cancellation prevents future billing but does not prorate or refund any paid period.

6.4 Free Trials and Promotions. We may offer free trials or promotional periods for Premium Features at our discretion. Eligibility, duration, and terms of such trials will be disclosed in the Service. Unless cancelled at least twenty-four (24) hours before the trial period ends via your App Store or device subscription settings, free trials will automatically convert to paid subscriptions at the then-current subscription rate. By initiating a trial, you authorize us to charge your payment method on file upon trial expiration. To avoid charges, you must cancel the trial before it ends.

6.5 Premium Features and Cloud Backup. Certain features of the Service, including all or portions of Cloud Backup, may be offered as Premium Features that require an active paid subscription. The specific scope of Premium Features, including any subscription-tier limits applicable to Cloud Backup, will be described in-app and may change over time. Behavior upon subscription lapse is described in Section 5.9.

7. TERM AND TERMINATION

7.1 Term. These Terms commence upon your first use of the Service and continue until terminated according to these Terms.

7.2 Termination by SafeMe. We may suspend or terminate your access at any time for breach of these Terms or misuse of the Service, without liability to you. Account-specific termination is addressed in Section 5.6.

7.3 Effect of Termination. Upon termination, your license ends, and you must cease all use of the Service. Your Account and any associated Cloud Backup data will be handled as described in our Privacy Policy. All provisions surviving termination (e.g., Sections 4, 5.10–5.13, 10–14, 18–20) shall remain in effect.

7.4 Discontinuation of Service. SafeMe reserves the right, in its sole discretion, to:

  • Discontinue, suspend, or modify the Service (or any part thereof, including Cloud Backup) at any time, with or without notice
  • Cease offering the Service entirely
  • Remove or disable access to any features or functionality
  • Transition the Service to a different platform or provider

In the event of Service discontinuation, or discontinuation of Cloud Backup specifically:

  • We will make reasonable efforts to provide 30 days’ advance notice via email or in-app notification
  • You may export your local data using available export features during the notice period, and where applicable you may restore Cloud Backup data to a device
  • We have no obligation to maintain or provide access to your data after discontinuation
  • We are not liable for any loss or damage resulting from Service discontinuation

You acknowledge that:

  • The Service may not be available indefinitely
  • Technology and business needs may require changes or discontinuation
  • Cloud Backup is not a substitute for your own backup practices, and you are responsible for maintaining independent copies of any data you wish to preserve

8. MODIFICATION OF TERMS

We may revise these Terms at any time in our sole discretion. We will post the updated Terms within the Service or on our website and update the “Last Updated” date. Continued use of the Service after notice constitutes acceptance of the revised Terms.

9. PRIVACY

Your privacy is governed by our Privacy Policy, incorporated herein by reference and available at https://suniq.app/privacy. By using the Service, you consent to the collection, use, and disclosure practices described therein.

10. INTELLECTUAL PROPERTY

All rights, title, and interest in and to the Service, including all software, designs, graphics, and trademarks, are owned by SafeMe or its licensors. You acquire no rights other than the limited license granted in Section 2. Your rights and SafeMe’s rights with respect to User Content are governed by Sections 5.10–5.13.

10.1 Third-Party Services

Certain features of the Service rely on third-party providers, including RevenueCat for payments, Google Analytics for usage insights, Apple Analytics for diagnostics, WeatherKit for UV data, and Google Firebase (Authentication, Cloud Firestore, and Cloud Storage) for optional account creation and Cloud Backup. Each third party operates under its own terms and privacy policies. SafeMe is not responsible for their availability, performance, or conduct.

10.2 Software Maintenance & Updates

SafeMe may provide updates, patches, and enhancements to the Service. You must install such updates to continue using the Service. SafeMe has no obligation to support or maintain prior versions.

10.3 Support

SafeMe may offer support via email ([email protected]) during business hours. Support is provided “as available” without any guaranteed service levels or response times.

10.4 Data Portability and Export. You retain full ownership of all data you create within the Service. SunIQ provides data export functionality allowing you to:

  • Export your vitamin D tracking history in standard formats
  • Save your sun exposure and tanning session logs
  • Download your progress analytics and reports
  • Extract your data at any time for personal use or transfer to other services
  • Note: Exported data is your responsibility to secure and protect once it leaves the app

10.5 Third-Party Links and Services. The Service may contain links to third-party websites, applications, or services that are not owned or controlled by SafeMe. These may include:

  • External articles or research about vitamin D, UV exposure, or tanning
  • Health and wellness resources
  • Social media platforms
  • Educational content

No Endorsement: The inclusion of any third-party link does not imply endorsement, approval, or recommendation by SafeMe. We do not endorse any third-party content, products, or services.

No Liability: SafeMe has no control over and assumes no responsibility for:

  • The content, accuracy, privacy policies, or practices of any third-party sites or services
  • Any damage or loss caused by your use of or reliance on such third-party content
  • Medical or health advice provided by external sources

Your Responsibility: You acknowledge and agree that:

  • You access third-party links at your own risk
  • You should review the terms and privacy policies of any third-party site you visit
  • Medical or health information from external sources should be verified with healthcare professionals
  • SafeMe is not responsible for any interactions between you and third-party providers

11. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

WITHOUT LIMITING THE FOREGOING, SAFEME SPECIFICALLY DISCLAIMS ANY WARRANTY THAT:

  • CLOUD BACKUP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • ANY PARTICULAR ITEM OF USER CONTENT WILL BE SUCCESSFULLY BACKED UP, PRESERVED, OR RESTORABLE
  • CLOUD BACKUP WILL PREVENT LOSS OF USER CONTENT
  • CLOUD BACKUP IS A SUITABLE REPLACEMENT FOR INDEPENDENT BACKUPS OR OTHER DATA PRESERVATION PRACTICES

YOU ACKNOWLEDGE THAT CLOUD BACKUP IS PROVIDED AS A CONVENIENCE AND THAT YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF DATA YOU WISH TO PRESERVE.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFEME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM LOSS OR CORRUPTION OF USER CONTENT, FAILURE OF CLOUD BACKUP TO PRESERVE OR RESTORE ANY PARTICULAR ITEM OF DATA, UNAUTHORIZED ACCESS TO YOUR ACCOUNT, OR INTERRUPTION OR DISCONTINUATION OF CLOUD BACKUP.

OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless SafeMe, its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with (a) your use of the Service, (b) your breach of these Terms, (c) your User Content, or (d) your violation of any third party’s rights in connection with User Content you upload.

14. DISPUTE RESOLUTION AND ARBITRATION

14.1 Informal Resolution. Prior to initiating arbitration or any formal dispute process, you and SafeMe agree to engage in good-faith negotiations. The claiming party must send a written Notice of Claim to the other via email or certified mail, including: (i) claimant’s contact information and counsel (if any); (ii) nature and basis of the claim; and (iii) relief sought.

14.2 Settlement Conference. Within thirty (30) days of Notice of Claim, the parties shall participate in a good-faith settlement conference by telephone or video conference, with individuals possessing settlement authority present.

14.3 Arbitration. If the dispute remains unresolved after the settlement conference, it shall be submitted to binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, including Supplementary Rules for Multiple Case Filings. Arbitration shall take place in Los Angeles County, California, before a single arbitrator selected in accordance with AAA rules. The arbitration will be conducted in English.

14.4 Class and Collective Claims Waiver. YOU AND SAFEME AGREE THAT ANY ARBITRATION SHALL PROCEED SOLELY ON AN INDIVIDUAL BASIS. CLASS, COLLECTIVE, OR REPRESENTATIVE CLAIMS, CLASS ARBITRATIONS, OR CONSOLIDATION OF INDIVIDUAL CLAIMS ARE EXPRESSLY WAIVED AND PROHIBITED. THIS PROVISION IS A MATERIAL INDUCEMENT FOR SAFEME TO ENTER INTO ARBITRATION.

14.5 Costs and Fees. The prevailing party may recover reasonable attorneys’ fees and costs as provided by applicable AAA rules or state law. Other fees and costs will be allocated as set forth in AAA rules.

14.6 Opt-Out. You have the right to opt out of this arbitration agreement by sending written notice to [email protected] within thirty (30) days of your first use of the Service. If you opt out, neither you nor SafeMe can compel arbitration for disputes arising under these Terms.

14.7 Injunctive Relief. Nothing in this arbitration provision prevents either party from seeking provisional or injunctive relief in a court of competent jurisdiction.

15. GOVERNING LAW

These Terms and any disputes will be governed by the laws of the State of California without regard to conflict-of-law principles. Venue for any court action is Los Angeles County, California.

17. MISCELLANEOUS

17.1 Severability. If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

17.2 Waiver. No failure or delay by SafeMe in exercising any right hereunder shall operate as a waiver of such right or any other right.

17.3 Assignment. You may not assign or transfer these Terms, or any rights or obligations hereunder, without SafeMe’s prior written consent. SafeMe may assign these Terms freely.

19. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any Additional Terms, constitute the entire agreement between you and SafeMe regarding the Service and supersede all prior agreements.

20. FORCE MAJEURE

Neither party shall be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, war, terrorism, riot, embargo, acts of civil or military authorities, fire, flood, accident, strikes, shortages of transportation or power, or interruptions of internet or utility services.

21. INTERNATIONAL USE

The Service is provided globally. If you access or use the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws. SafeMe’s provision of the Service does not require it to ensure compliance with local regulations in jurisdictions where you use the Service.

22. FEEDBACK

You grant SafeMe a perpetual, irrevocable, worldwide, royalty-free, transferable license to use, reproduce, modify, and implement any feedback, suggestions, or ideas you provide regarding the Service, without obligation of compensation to you.

23. TRANSLATION AND INTERPRETATION

The English version of these Terms is the controlling text. Translations are provided solely for convenience. In the event of any conflict between the English version and any translation, the English version shall prevail.
