Purpose of This Policy
This Consumer Health Data Policy (“Health Data Policy”) supplements the SunIQ Privacy Policy and applies in circumstances where information that SafeMe Inc. (“SafeMe,” “we,” “us,” or “our”) processes through the SunIQ application or website (suniq.app) may be considered “Consumer Health Data” subject to the Washington My Health My Data Act, the Nevada Consumer Health Data Privacy Act (SB 370), or other applicable U.S. state consumer health privacy laws (“Applicable State Laws”).
When we say “Consumer Health Data,” we mean personal information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status, as defined by Applicable State Laws. Capitalized terms not defined in this Health Data Policy have the meanings given to them in our Privacy Policy.
About SunIQ and Consumer Health Data
SunIQ is a local-first vitamin D and sun exposure tracking application. It is not a medical device, does not provide medical advice, and is not a substitute for professional healthcare. SunIQ is designed so that the most sensitive information you enter — including your personal profile, supplement and food intake, lab test results, vitamin D blood-level estimates, and session notes — is stored only on your device and is never transmitted to our servers.
Given the breadth of Applicable State Laws, a limited portion of the information SunIQ processes may be considered Consumer Health Data. This Health Data Policy describes how we handle that information.
1. Categories of Consumer Health Data We Process
The following categories of information processed by SunIQ may be considered Consumer Health Data under Applicable State Laws:
- Vitamin D intake and status information: daily vitamin D intake totals from sun, food, and supplements; vitamin D blood-level estimates; and lab test results you choose to record.
- Sun exposure information: sun session duration, start and end times, and UV index readings at the time of a session.
- Tanning activity information: tanning session duration and intensity, and tan-logging photos you choose to save.
- Skin characteristics: your Fitzpatrick skin type.
- Supplement and dietary intake: vitamin D supplement amounts (IU) and foods consumed with their vitamin D content.
- Physical attributes used for calculations: age and weight, used to personalize vitamin D and UV exposure estimates.
- Session notes: free-text notes you choose to add to sun or tanning sessions.
- Precise location information used to retrieve UV index data for a session, to the extent that such location could reasonably indicate an attempt to obtain health services or supplies.
2. Sources of Consumer Health Data
We collect or process the categories of Consumer Health Data described above from the following sources:
- Directly from you: information you enter into the SunIQ app (profile, supplements, food, lab results, session notes, photos).
- Your device’s sensors: location data collected while you use the app, used to fetch real-time UV data.
- Apple Health, if you explicitly grant permission: age, weight, existing vitamin D intake records, and UV exposure data from other apps.
- Apple WeatherKit: UV index and weather data for your location (SafeMe does not send your health data to WeatherKit).
We do not purchase Consumer Health Data from data brokers, and we do not receive Consumer Health Data from advertising, marketing, or analytics providers.
3. Purposes of Collection and Use
We process Consumer Health Data solely to provide and support the SunIQ application, including to:
- Calculate your daily and cumulative vitamin D from sun exposure, food, and supplements.
- Estimate vitamin D generated from sun exposure based on UV index, skin type, and exposure duration.
- Provide safe sun exposure timers and burn-risk guidance.
- Track sun exposure and tanning activity history and display progress charts.
- Send optional reminders and alerts you have enabled.
- Diagnose technical issues and support the operation and security of the Service.
We do not use Consumer Health Data for advertising, marketing, profiling for commercial purposes, or sale, and we do not use it to train machine learning models.
4. Categories of Consumer Health Data Shared, and with Whom
We do not sell Consumer Health Data. We do not share it for advertising or marketing purposes. Most Consumer Health Data processed by SunIQ is stored only on your device and is not shared with anyone. The limited circumstances in which Consumer Health Data may be disclosed are described below.

SunIQ uses additional Google services (Firebase Analytics, Firebase Crashlytics, Firebase App Check, and Firebase Remote Config) for product analytics, crash reporting, backend request verification, and application configuration. These services are configured so that they do not receive the categories of Consumer Health Data described in Section 1. Analytics and crash data are limited to pseudonymous usage patterns, device information, and technical diagnostics.
In addition, we may disclose Consumer Health Data (a) to law enforcement or other parties in connection with valid legal process, to comply with applicable law, or to prevent harm; and (b) to parties in a corporate transaction (such as a merger, acquisition, or sale of assets), subject to customary confidentiality obligations and consistent with Applicable State Laws.
Specific Affiliates
SafeMe Inc. has no affiliates that receive Consumer Health Data.
5. Consent
Where required by Applicable State Laws, we rely on your consent to process or share Consumer Health Data:
- Your voluntary entry of information into SunIQ (for example, logging a sun session, entering a lab result, or saving a tan photo) constitutes your consent to process that information as described in this Health Data Policy.
- Enabling our optional Cloud Backup feature requires a separate, express opt-in and constitutes your consent to share the limited categories of Consumer Health Data listed above with Google for the purpose of backup and restore.
- Enabling Apple Health integration requires a separate permission that you grant through iOS.
- You may withdraw your consent at any time by disabling Cloud Backup, revoking Apple Health permissions in iOS Settings, deleting specific entries within the app, or deleting your account.
6. Your Rights
If you are a Washington resident, a Nevada resident, or a resident of another jurisdiction whose laws grant rights regarding Consumer Health Data, you have the following rights, subject to verification and legal exceptions:
- Right to confirm: You may ask us to confirm whether we are collecting, sharing, or selling your Consumer Health Data.
- Right to access: You may request access to the Consumer Health Data we hold about you, along with a list of third parties and affiliates with whom we have shared it and their contact information.
- Right to delete: You may request deletion of your Consumer Health Data. Because most Consumer Health Data is stored only on your device, deleting the app or specific entries within the app is the most direct way to delete this data. For any Consumer Health Data we hold through Cloud Backup, you may delete individual entries, your full cloud backup, or your entire account from within the app at any time. If you submit a deletion request to us, we will, where applicable, direct our processors to delete the data as well.
- Right to withdraw consent: You may withdraw any consent you previously gave for the collection or sharing of your Consumer Health Data.
- Right to appeal: If we decline to act on your request, you may appeal our decision.
How to Exercise Your Rights
To exercise any of the rights above, please email us at [email protected] with the subject line “Consumer Health Data Request.” Please send your request from the email address associated with your SunIQ account (if you have one) so that we can verify your identity. We may ask you for additional information reasonably necessary to verify your request and to protect against unauthorized access to your data.
We will respond to your request within 45 days of receipt, except where a longer period is permitted by law. If we need additional time (up to an additional 45 days) due to the complexity or number of requests, we will inform you of the reason and the extension period.
How to Appeal
If we deny your request, you may appeal by replying to our response email or by writing to [email protected] with the subject line “Consumer Health Data Appeal.” We will respond to your appeal within 45 days.
If your appeal is unsuccessful, you may file a complaint with:
- The Washington State Attorney General at www.atg.wa.gov/file-complaint
- The Nevada State Attorney General at ag.nv.gov
- Any other regulatory authority with jurisdiction over you.
7. Changes to This Policy
We may update this Health Data Policy from time to time. If we make material changes, we will provide advance notice through the SunIQ app or on our website before the changes take effect. The “Last updated” date above indicates when this Health Data Policy was most recently revised. We will not collect, use, or share additional categories of Consumer Health Data, or process Consumer Health Data for additional purposes, that are not disclosed in this Health Data Policy without first disclosing the additional categories or purposes and obtaining your affirmative consent.
